Description

Our client in Aberdeen are recruiting for a Solicitor ( Commissioning and Procurement ) on an interim basis of 3 months with the possibility to extend up to a maximum of a further 4 months who will be responsible for leading the Commercial Legal Team

The typical working week will be 37 hours ( Monday – Friday ) with a negotiable daily rate based on the skills and experience of the candidate

The Postholder will:

* Be principal point of contact for the commercial legal team
* Appropriately allocate, supervise and assess the priority of work of the team
* Contribute to the development and design of internal policies, risk registers, processes and procedures relating to commercial and procurement aspects of the client’s business
* Represent the business in a professional capacity at meetings of elected members
* Provide the senior management with strategic advice and guidance on potential lawful solutions, including advice on managing risk
* Deputise for the Head of Commercial and Procurement as required
* Take on a share of the Commercial Legal Team’s workload

Duties of the Commercial Legal Team typically comprises of:

* Advising on internal governance arrangements in respect of procurements and commercial contacts
* Supporting non-legal procurement officers with queries re. public procurement legislation and compliance issues
* Drafting terms and conditions for above threshold procurements
* Maintaining standard terms and conditions for use in below threshold procurements
* Maintaining standard terms and conditions for social care contracts
* Drafting bespoke agreements where the standard terms and conditions would not be appropriate, i.e. consultancy services, non-disclosure agreements, agreement for joint working with other organisations, terms and conditions for services, supplies or works where grant funding is being used to fund expenditure, IT software agreement/ licences
* Reviewing third party terms and conditions, where standard terms and conditions are not accepted (mostly purchases of IT software); Reviewing framework agreements which council officers wish to use for legality of use and deviances from the standard terms and conditions
* Reviewing business cases and committee reports that involve commercial and / or procurement elements
* Reviewing grant agreements for incoming grant funding
* Drafting bespoke grant agreements and maintaining standard terms for out-going grant funding
* Providing internal legal support to capital projects
* Attending committee to answer questions on work you have been involved
* Reviewing and advising on contract terms where the organisation is dissatisfied with the performance of a supplier
* Drafting termination notices for contracts

Essential skills and competencies required:

* Admitted as a solicitor in Scotland and holding a Practising Certificate from the Law Society of Scotland
* Detailed working knowledge and experience of relevant current legislation and practice in commercial, contract and procurement law

Desirable skills for the role:

* Experience of working in an inhouse legal team
* Experience of managing people, allocating work and managing workloads

The Postholder will be required to hold a Standard Disclosure
